陳前總統涉嫌侵占國家機密文件，被控瀆職，但因為身體健康亮紅燈，轉送台中培德醫院治療後，已經11個月沒出庭。但上午法官不准假，陳前總統凌晨6點從台中北上，抱病出庭，不過民間醫療小組成員陳昭姿就說，陳前總統尿失禁次數已經高達12次，表達能力也有障礙，居住環境就像禁閉室，不明白法官為何非得要強迫陳前總統出庭。
去年8月，前總統陳水扁為侵占公文案出庭，身影削瘦、精神狀況也不佳，過了11個月，上午再次抱病出庭，但因為法院刻意拉下鐵門，媒體完全無法拍攝到陳前總統。
陳前總統的民間醫療團隊，也提出強烈質疑，不明白為何非得要強迫陳水扁出庭，因為陳水扁出現口吃、手會每秒不自主顫抖6.6次，而且尿失禁的次數已經從每天8次，增加到每天12次，恐怕也有小腦病變的徵兆，醫療團隊更指出，陳前總統在長期的監禁下，日夜都開著燈，睡也睡不好、不知道時間、更無法和旁人接觸，曬不到太陽，精神狀況相當差。
醫療團隊擔憂，陳前總統的健康狀況會越來越不好，推估不用3到5年，就可能長期臥病在床，狀況會比吳淑珍還差，因此希望提出自費延醫，或者回到台北榮總接受診療，讓病情慢慢好轉。(民視 2013-07-30)

前總統陳水扁移監台中監獄培德醫院後，因身體狀況不佳始終未曾出庭，不過審理扁被控侵占國家機密文件案的台北地院，近日評估後認為扁應可出庭，已訂期於今早提訊扁出庭，另因路途遙遠為恐橫生枝節，已低調責由法警，凌晨前往培德醫院提訊扁上台北。
台中監獄表示：「根據三份醫療報告顯示，扁病情穩定，有持續治療中並無大礙，只要法院來帶人，就會讓扁出庭。」律師團則說，昨緊急以扁精神不佳、有憂鬱症為由再請假。但據了解，北院已駁回請假，仍將按原計劃開庭。
已11個月未出庭
陳水扁目前仍有多案在法院審理，但去年八月他為此案出庭後，即因生病及精神問題住進北榮、培德醫院，並陸續向各合議庭請假、聲請暫停審理，已近十一個月未出庭。
但台北地院認為，扁案並無停審必要日前已駁回聲請，法官指出，扁目前是服刑狀態，無理由不出庭，因此昨駁回他的請假，決定提他出庭。
立委陳亭妃昨指出，扁一天漏尿十二次，台中榮總卻診斷不出病因，「難道真要讓扁等死嗎？」醫師郭正典說，扁的腦病變益發嚴重，已步步邁向臥床、廢人。

亳無人性的法務部！
According to Apple Daily (see the report below in Hanji), on July 30th, Taipei circuit court ordered President Chen to appear in court despite his various illnesses. According to DPP legislator, Chen Ting-Fay, President Chen now wets his pant as high as 12 times a day. Dr. CD Kuo also points out that his brain condition continues to worsen. However, Taichung Prison authority informed Taipei Circuit Court that "According to three medical reports, his condition is stable and has been receiving medications without major issues. If the Court sends for him, we will prepare him to appear in court." Therefore, Taipei Circuit Court demands President Chen to appear in the case in which he is accused of stealing classified documents. The court marshall took President Chen from Taichung Prison to Taipei Court in the early morning of July 30th. According to records, President Chen has not appeared in any court cases since his emergency room visit last August, for 11 months. Taipei Court denied President Chen's petition to be absent due to his illness because the Court considers President Chen fit enough to appear in court.

(Note that this stealing classified documents case is one most bogus and ridiculous case, fabricated to humiliate President Chen. President Chen is accused of taking more than 10 boxes of documents from his presidential office when he stepped down to his Ex-Presidential Office. The documents are historical documents during his presidency for his memoir. He did not even have a chance to open any of these boxes because he was soon placed in custody. The Ex-Presidential Office is recognized as a government office. Moving the documents from one government office to another is considered stealing by Ma while Ma moved his Taipei Mayor Discretionary Fund to the private bank account of his wife is considered legal. The Special Prosecution Panel wrote an indictment with over 1 million words for this "crime". In the mean time, this same Prosecution Panel dropped all the cases against Ma, including a recent case accusing Ma of obtaining wealth from unknown sources. If you go to any presidential libraries of any ex-president of the US, you will find exhibitions of many historical documents. This case against President Chen is similar to accusing all these ex-US-presidents stealing those documents. I wonder if this case and this forced court appearance are considered fair treatments by Prof. Jerome Cohen because he, in his recent interview with New York Times, declared that he would like to see President Chen being treated fairly even though he did not care much for President Chen and his family.)
